Massachusetts law is very clear about the consequences to the owner and the recovery that can be sought by victims of dog bites and domestic animal attacks. General Law, Chapter 140, Section 155 defines Massachusetts as a strict liability state when it comes to dog bites. That means the animal’s owner is automatically liable for the animal’s behavior unless it can be proven that the victim taunted the dog or was trespassing.

The only exception to this rule is if the victim is under 7 years old. In such cases, the burden is on the dog owner to prove that the young child was trespassing or knowingly taunting the dog. Also, treating doctors must notify the inspector of animals within 24 hours of dog bites to small children, so that the inspector can investigate if the animal should be classified as a public hazard.
